Splošni pogoji poslovanja

1. Introductory Provisions
1.1. These general terms and conditions (hereinafter: the Terms) apply to the offer, ordering, and production of custom-made clothing by Mangala, Maša Dobravec s.p. (hereinafter: the Provider), based in Ljubljana, VAT ID: 36743666, email: masadobravec@gmail.com.
1.2. The customer confirms acceptance of these Terms by confirming the order or offer. The Provider reserves the right to amend or supplement the Terms, which are published on the website or sent to the customer.


2. Offer and Conclusion of Contract
2.1. The Provider prepares a custom offer based on the customer’s requirements – including measurements, choice of materials, color, details, and production timeline.
2.2. The contract is concluded by signing the offer or confirming it via email, phone, or other communication channels.


3. Prices and Offer Validity
3.1. All prices are expressed in euros (€) and do not include VAT (the Provider is not a VAT payer).
3.2. The offer is valid for 14 days from the date of issue unless otherwise agreed.
3.3. Promotional or discounted prices are listed in the offer and apply only to that specific offer.


4. Payment Terms and Deadlines
4.1. The order is confirmed with the following payments:

  • 50% of the value upon confirmation of the offer and receipt of the order,

  • 50% of the value upon final delivery of the item.
    4.2. A one-time full payment of 100% upon order confirmation is possible by agreement.
    4.3. Payment can be made via bank transfer or, by prior arrangement, by card or PayPal.
    4.4. In the event of delayed payment, the Provider reserves the right to charge statutory default interest.


5. Production Timeline and Delivery
5.1. The standard production time is up to 14 working days from receipt of all necessary data, confirmation of the offer, and receipt of the initial payment.
5.2. In case of additional requirements or adjustments, the deadline is extended accordingly and extra requests are priced separately.
5.3. Delivery is deemed completed when the customer receives the final item without objection or as otherwise agreed.


6. Cancellation and Complaints
6.1. The customer may cancel the order in writing no later than 24 hours before production begins. After production starts, cancellation or refunds are not possible.
6.2. The customer must inspect the item upon delivery. Any material defects must be reported in writing within 8 days of receipt, along with a description and photos if possible.
6.3. A complaint is considered valid if:

  • the product deviates from the confirmed agreement (e.g. incorrect size despite accurate measurements),

  • the item has defects in stitching, material, or workmanship that reduce usability,

  • the product does not match the confirmed sketch, description, or agreed-upon elements.
    6.4. A complaint is not valid if:

  • the customer provided inaccurate or incorrect measurements,

  • the item was damaged due to improper handling, washing, or maintenance,

  • dissatisfaction is based on subjective opinions about color, fit, or style that were previously approved,

  • minor variations in handcrafting or materials occur, which are typical of artisanal production.
    6.5. In the case of a justified complaint, the Provider will:

  • repair the item free of charge as soon as possible,

  • or, by agreement, produce a replacement,

  • or (if repair or replacement is not possible) refund a proportionate amount.
    6.6. The Provider covers return shipping costs for justified complaints. In all other cases, the customer bears the return cost.
    6.7. Exclusion of the right to withdraw from the contract: Since the product is made to the customer’s specific instructions and tailored to their personal needs, the customer does not have the right to unilaterally withdraw from the contract within 14 days without reason, in accordance with applicable legislation (Directive 2011/83/EU, Slovenian Consumer Protection Act).


7. Retention of Ownership
The Provider retains ownership of the item until the customer has paid in full. Until full payment is made, the customer does not have the right to use or distribute the item.


8. Disclaimer of Liability
8.1. The Provider is not liable for damages resulting from improper use of the custom-made garment.
8.2. Aesthetic differences due to natural material properties are not grounds for complaint, unless they are a result of obvious defects.
8.3. The Provider does not guarantee full alignment with external expectations such as trends or aesthetic preferences, as these are confirmed in advance by the customer.


9. Personal Data Protection
9.1. The Provider processes personal data solely for the purpose of fulfilling the order: name, surname, contact details, and address.
9.2. Data is stored and processed in accordance with GDPR. The customer has the right to request access, corrections, or deletion of their data.
9.3. Personal data is not shared with third parties without explicit consent, unless required by law.


10. Intellectual Property
All images, samples, designs, and documents provided by the Provider are protected by copyright. The customer may use them only for personal use of the item (personal wear). Any commercial use without written permission is prohibited.


11. Cookies and Website Content
Cookies are used on the website – users are informed about this in the site’s Cookie Policy. This does not form part of these Terms.


12. Customer Responsibility
The customer guarantees that all submitted information and personal data are accurate and owned by them. The customer is responsible for providing complete and timely measurements and expectations.


13. Dispute Resolution
The Provider aims to resolve any disputes amicably. If this is not possible, the competent court in Ljubljana shall have jurisdiction.
